=== Value-based fee for the infringement action ===

 1. The value of the infringement action shall be determined by the judge-rapporteur where the value of the dispute is assessed by one or both parties as exceeding [EUR***] by way of order during the interim procedure. 

 2. Where the value of the infringement action exceeds [EUR***], the claimant shall pay a valuebased fee for the infringement action, in accordance with Part 6 [Rules [[UPCA_RoP_370|370.2]](b) and [[UPCA_RoP_371|371.4]]].
