Rule 61

Exchange of written pleadings (action for declaration of non-infringement)

1. The written procedure shall consist of

   • (a) the lodging of a Statement for a declaration of non-infringement (by the claimant) [Rule 62 ],
     (b) the lodging of a Defence to the Statement for a declaration of non-infringement (by the defendant) [Rules 65, 66 ].
     (c) the lodging of a Reply to the Defence to the Statement for a declaration of non-infringement [Rule 67].
     (d) the lodging of a Rejoinder to the Reply [Rule 67].

2. Rule 12.5] shall apply.
