Rule 89
Examination as to formal requirements (ex parte proceedings)
The Registry shall, as soon as practicable after an Application to annul or alter a decision of the Office has been lodged, examine whether the requirements of Articles 47(7) and 49(6) of the Agreement and Rule 88.1, .2(a) to (d) and .4 have been complied with.
- If the Registry considers that any of the requirements referred to in paragraph 1 has not been complied with, it shall invite the claimant to
(a) correct the deficiencies noted, within 14 days,
(b) where applicable, pay the fee for the action against a decision of the Office, within 14 days.
The Registry shall at the same time inform the claimant that if the claimant fails to correct the deficiencies within the time stated a decision by default may be given in accordance with Rule 355.
- If the claimant fails to correct the deficiencies noted or to pay the fee for the action against a decision of the Office, the Registry shall inform the President of the Court of First Instance who may reject the action as inadmissible by a decision by default. He may give the claimant an opportunity to be heard beforehand.
The claimant may make an application to set aside the decision by default in accordance with Rule 356.
