Rule 133

Value-based fee for the determination of damages

Where the value of the determination of damages is assessed by the applicant to exceed [EUR***] the applicant shall pay a value-based fee for the determination of damages in accordance with Part 6 [Rules 370.2(b) and 371.4]

Notes

In the technical consultation it has been questioned whether a value-based fee is appropriate where such a fee has already been paid in the original infringement proceedings.
